High Court Judge Sulet Potterill announced that the Government of South Africa should drop the tender deal of purchasing the female condoms from China-based Company Siqamba Medical.
The Chinese condoms were found to be too small to be used by the people of South Africa and the material like polyurethane was used in the condoms instead of nitrile, which was inappropriate for women.
Moreover, the reports from Beeld newspaper state that these female condoms have been disapproved by World Health Organization, the US Food and Drug Administration Agency and the SA Bureau of Standards.
Also, another company Sekunjalo Investments Corporation had filed a case against the tender. The Company stated that Phoenurse condoms produced by the Chinese company were 20% lesser in size than that of produced by Sekunjalo. Therefore, the court had forbidden the commencement of the 11 million condoms deal with China.
Judge Sulet Potterill favored the Sekunjalo and stated that this Company should be given the contract of supplying the condoms. The decision taken by the court was in concern with avoiding the spread of the incurable disease of HIV/AIDS.
As per the judgment, the Cape Town based Sekunjalo Investments Corporation will be distributing the female condoms in the market of South Africa. These condoms were produced by Female Health Company (FHC), which has been certified by the WHO, FDA and SABS.

Johannesburg - The North Gauteng High Court in Pretoria has set aside a government decision to award a tender for Chinese-made condoms, according to a report on Friday.
This was because the condoms were too small, made of the wrong material and were not approved by the World Health Organisation, the US Food and Drug Administration Agency or the SA Bureau of Standards, according to the Beeld newspaper.
Judge Sulet Potterill set aside the finance minister's decision to award the contract to Siqamba Medical of KwaZulu-Natal, which won a tender to supply 11 million Phoenurse condoms manufactured in China.
Another company, Sekunjalo Investments Corporation, had turned to the court after losing the tender.
Potterill ruled that Sekunjalo should get the tender and said it was an urgent matter, since it affected the spread of HIV/Aids.
The court heard that the Phoenurse condoms were 20% smaller than Sekunjalo's and were not made of the required material.

Potterill het gesê Sekunjalo het vóór die tender tussen ses en sewe jaar lank kondome aan die staat verskaf wat deur die Female Health Company (FHC) vervaardig is.
Die FHC het tans die enigste vroulike kondoom wat deur die FDA gereguleer word. Die WGO se tegniese hersieningskomitee het ook dié produk goedgekeur.
Potterill het gesê dit is gemeensaak die staat se verskaffing van kondome is van nasionale noodsaaklikheid om die verspreiding van MIV/vigs en ongewenste swangerskappe te bekamp.
Die tender is dus dringend.
Potterill het gesê die minister van finansies het nie ontken nie Siqamba se tender is totaal gebrekkig.
Die Phoenurse word in China gemaak, maar nie van die vereiste materiaal nie.
Dit is ook 20% kleiner in deursnee as Sekunjalo se kondoom.
Die minister van finansies het geen redes gegee vir sy besluit nie, het Potterill gesê.
